Curlin Owners to Remain in Jail

On Sept 11, a judge rule that William Gallion and Shirley Cunningham Jr., owners of Preakness winner Curlin, will remain in jail until they account for money that went missing in the lawsuit over the diet drug fen-phen.

The pair were indicted along with another colleague for conspiracy to commit wire fraud.

The colleague’s handle a major lawsuit against the drug company and are being accused of taking $64 million dollars that should have gone to their clients in the $200 million settlement.

U.S. District Judge William Bertelsman said he would consider releasing the men if they could come up with a detailed accounting of what happened to the money. The judge said in order to determine the appropriate bond for the defendants he needs to know how much money there is and where they have it, as it’s a concern that the men have the resources to flee the country. 

"My intent is to detain them until their financial reports are filed in total.'" Bertelsman said. "I need to know where the money went from that settlement."
